Stefan Buerge joins Probst Partner AG
We are pleased to announce that Stefan Bürge is joining Probst Partner AG as counsel. Stefan Bürge advises and represents clients particularly in scale-up, sustainability and intellectual property matters. As a solution-driven legal generalist, he has deep expertise in crafting and negotiating meaningful collaborations between organizations and is specialised in protecting and using inventions and know-how. This also includes technology development and go-to-market strategies. Further, he leverages his experience to provide hands-on and strategic advice for the creative and non-profit sectors (foundations, associations).
Autonomous driving in Switzerland
As of March 1, 2025, freeway pilots, parking pilots and full autopilots may be used in motor vehicles in Switzerland. A new ordinance regulates the registration and use of motor vehicles with an automation system as well as the processing of data associated with such vehicles (Art. 1 Ordinance on Automated Driving, VAF, SR 741.59).
The obligations are addressed to manufacturers, but also directly or indirectly to manual drivers or operators, i.e. the natural persons who supervise the vehicle in operation (Art. 34).
The Ordinance distinguishes between three types of automation systems (Art. 2 VAF):

As in previous years, Probst Partner was present at this sixth edition with its own booth to keep its finger on the pulse of the startup community and to offer legal advice. Lawsuit concerning copyright law in Germany: Eric Clapton sues a woman in Germany for selling a CD on ebay that was not authorised by Eric Clapton
Current press reports cover a copyright lawsuit in Germany. The world-famous musician Eric Clapton is said to have sued a woman because she wanted to sell on ebay a CD of one of his concerts, which the musician apparently did not authorise. The lawsuit is not directed against the producer of the said CD, but the private person who wanted to resell the CD online is sued.
